Hawaii family advocate settles lawsuit against state agency for violations of civil rights. State loses motion to dismiss. NEW!
  
It seems that certain caseworkers in Honolulu are pretty thin skinned, especially after reading a fax sent out by Hawaii Family Advocate, Johnny Rayford, equating CPS case workers with sociopaths. (The offending article was first published on AFRA’s web site). That perceived character assassination coupled with them being denied access to Mr. Rayford’s training seminar (presented by AFAC), his extraordinary success rate as a family advocate at reuniting families and his success at getting family advocate legislation passed, got their panties in a knot, and they complained to Hawaii Community Action Program (HCAP). HCAP had provided office space to Mr. Rayford for his Hawaii Family Advocacy Center and referred clients to him.
     The complaint resulted in HCAP evicting Mr. Rayford from his office. They also stopped referring clients to him. Mr. Rayford contacted us with his dilemma. We advised him that the caseworkers may have violated his civil rights, and encouraged him to contact an attorney. It was not difficult to find an attorney to take this case on a contingency. Discovery commenced, and the case workers ultimately filed a motion to dismiss and
lost. The case was settled in favor of Mr. Rayford.
     While we have not been given leave to disclose the amount, we can say. . .
Yes, Virginia, Hawaii CPS had to write a big fat check to Mr. Rayford, trained Family Advocate. Hopefully, Hawaii will now train their case workers about Constitutionally protected rights.
